CHENNAI:The action of the Judge of the High Court is not in accordance to the Constitutional scheme. He should resign or be removed.

No law abiding citizen can allow a High Court Judge to hijack the court proceedings.

If a law abiding citizen applies for police permission to conduct a peaceful demonstration to save the Constitution of India and if the police refuse and the High Court is approached and an order to grant permission is given, if still, the police refuse permission, will the Judge of the High Court order the security on duty (here the CISF) to protect the High Court, to escort the petitioner to conduct the demonstration?

If not, is it not a case of violating article 14 of the Constitution of India?

What is ordered for a person claiming to be a devotee of a particular god is denied for a citizen who is in deep devotion to the Constitution of India.

If the court starts ordering its security staff to protect the individuals or organisations approaching the court, it is not upholding justice, but a malafide intention to project that the law and order has failed in the State.

This is not only misusing the constitutional authority but also making the parliamentary democracy meaningless.

If the court’s order is not respected there is a legal process called contempt of court.

The concerned High Court Judge has not only taken the law into his own hands and violated the oath of office but also played into the hands of forces which is trying to do everything possible to make the people lose faith in democracy.

This kind of action by a High Court Judge will lead to anarchism.

State Platform for Common School System – Tamil Nadu (SPCSS-TN) strongly condemns the action of the concerned High Court Judge in ordering the CISF on duty to protect the High Court campus to escort the petitioner to do certain deeds according to the wishes of the petitioner against the public order.

The concerned judge of the Madras High Court should resign or should be removed to uphold the Constitutional scheme of impartiality of the Court and restore confidence on the judiciary.
